An illegal “public shelter” for strays discovered in Bragadiru, Romania

Today, we gathered a group of people and we went to Bragadiru, at the shelter that belongs to ASPA that is on a field in Rahova Jail,
where there used to be pig farms. Here, the public is not allowed to enter at all!
The people from there refuse to give us any information, telling us to contact the
Press office of the municipality. From the Kanal D reporter we found out that Bancescu declared that the shelter
is not yet authorised to function and they are waiting for the authorisation.
That is a bigger illegality than the fact that they don’t allow us in there.
These are all the articles of the law that are violating the law:
1. This shelter does not have an authorisation to function, but it does, dogs from Mihailesti
and Pallady shelters are being brought here with cars that don’t even have the ASPA
signs on them, like it says on the article 12:
(2). The transport vehicles that are meant for stray dogs must be visibly marked
with the name of the animal control service, the phone number, identification number, individual crates
that are well fixed to prevent their displacement during the transport and well ventilated.
Then, article 5:
(5)In the public shelters can be housed the stray dogs that have been captured from the areas belonging
to the municipality that built she shelter. Also dogs from the nearby municipalities, under the 4th amendament.
The operators of the services for stray dogs management must only transport and accomodate the captured dogs
in the shelters that they manage.
If the inmates are the ones that work in there and the location belongs to the jail,
one can only wonder who is the manager, ASPA or the Penitenciary administration?
And how about the law article?

2.It does not meed the necesary requirements for a shelter. Art 5:
(5)It is forbidden to accomodate stray dogs in public shelters that do not respect the minimal conditions
to function, that are present in addendum nr 1 of the law.

3. The shelter has a “special regime” according to the guards in there- this does not exist when it comes
to shelters. They can only be public or private. The law doesn’t mention this “special regime”.

4.Access in the shelter is not allowed. Although it has a suspect title, given the
fact that dogs captured from the streets of Bucharest are brought here the shelter qualifies
as a public one, where public is allowed.
art 6(1) Public access in the public shelters is made based on a schedule established by the
service of stray dog management, daily, from Monday to Friday, between 10.00 a.m and 18.00pm
(2) Saturdays and Sundays and during legal holidays, public access is established by the local coouncil.
(3) The reclaiming of the stray dogs can be made during the horary for public access, that is established in (1) and (2).
(4) The access of the visitors in the public shleters is made by respecting the internal rules and regulations.
(5) Visitors are allowed to photograph and film the dogs in the public shelters.

These are only a few of the legal issues that are being broken by the ASPA adminstration!

After hours of standing in front of the shelter, where we were ignored, phone calls to the Municipality,the press office
AsPA, whithout a concrete answer, we dialed 112 and asked for a police intervention.
They arrived there, we explained what happened, told them that the law is being broken and that we should be allowed to see the dogs,
it was clear that they could not understand us. They made a few calls,went in the car and ran away from there
whithout any explanation. We dialled 112 again, asked for another police intervention and they just hang up on us.
All these things were filmed by Kanal D operators and they were broadcasted on the news. So the Romanian Police refuses to obey the law.
About the conditions of the shelter, photos speak for themselves…
The photos were taken over the fence, we climbed on rocks and cars for that…
The discussion with the people that were inside took place through the fence, they refused to open and talk face to face like
in a civilised country in the E.U
Barebed wire everywhere, dogs barking. I could not photograph the dogs that were outside, i think i only could see the part where they hadn’t
put dogs yet. Only one photo, taken by someone else shows that there are dogs in there, and they are a lot in a very small place, we could not see
any water or food bowls or if dogs had access inside also. They were cuddled into each others, freezing.
It seems only fair that all these issues raise a lot of questions.
What will happen to these dogs is the first question that pops our minds

From the photos that were taken over the fence, we can see that the security is provided by the Horseback Police,
a service that was externalised by the Municipality to a private company, FANDAX GRUP. What’s next?

Ecarisajul Bragadiru – legal sau nu?

Astazi un grup de oameni am fost la Bragadiru, la noul adapost care apartine de ASPA, insa care se afla pe un spatiu detinut de Penitenciarul Rahova, la fostele ferme de porci. Aici accesul este TOTAL interzis publicului. Cei de acolo refuza sa ne dea mai multe informatii, ne spun sa luam legatura cu Biroul de Presa al Primariei Capitalei. De la reportera Kanal D aflam cu stupoare ca Bancescu le-a declarat ca adapostul nu are autorizatie de functionare si ca sunt in asteptarea ei. De altfel asta este o incalcare a legii mult mai mare decat faptul ca nu ne permit accesul. Dar sa o luam treptat cu articolele din lege care se incalca:
1. Acest adapost NU ARE autorizatie de functionare, dar functioneaza, cainii din bazele Mihailesti si Pallady sunt adusi aici, cu masini care nici macar nu poarta inscriptia ASPA, asa cum ar scrie la art 12:
(2) Mijloacele de transport destinate câinilor fără stăpân trebuie sa fie vizibil marcate cu denumirea serviciului de gestionare a câinilor fără stăpân, cu numărul de telefon, cu indicativul mijlocului de transport, dotate cu cuşti individuale fixate corespunzător pentru a preveni deplasarea lor în timpul călătoriei şi ventilate corespunzător.

Apoi, Conform art 5:
(5) În adăposturile publice pot fi adăpostiţi câinii fără stăpân capturaţi pe raza unităţilor administrativ- teritoriale care le-au amenajat, precum si câinii fără stăpân din unităţile administrativ-teritoriale vecine in conditiile alin. (4). Operatorii serviciilor specializate pentru gestionarea câinilor fără stăpân au obligaţia de a transporta şi a adăposti câinii capturaţi numai în adăposturile publice pe care le administrează.
Pai daca detinutii sunt cei care lucreaza acolo, locatia e a penitenciarului, ma intreb cine il administreaza ASPA sau Administratia Penitenciarelor? Si atunci cum ramane cu articolul de lege?

2. Nu indeplineste conditiile necesare unui adapost. Art.5:
(2) Este interzisă cazarea câinilor fără stăpân în adăposturi publice care nu respectă condiţiile minime de funcţionare prevăzute în anexa nr. 1 ordonanţa de urgenţă.

3. Titulatura acestui adapost este declarata de cei de la paza unitatii “cu regim special” – aceasta titulatura nu exista in cazul unor adaposturi. Pot fi publice sau private. Nu gasesc nicaieri in lege sau norme, titulatura “regim special”

4. Accesul in adapost nu este permis. Desi are o titulatura suspecta, avand in vedere ca aici sunt aduci caini fara stapan, ridicati de ASPA de pe strazile Bucurestiului, prin lege devine adapost public, in care accesul publicului este permis.
Art. 6. – (1) Accesul publicului în adăposturile publice se face în baza unui program stabilit de serviciul de gestionare a câinilor fără stăpân, zilnic, de luni până vineri, în intervalul orar 10.00 – 18.00.
(2) Sâmbăta şi duminica şi în timpul zilelor de sărbători legale, accesul publicului, în vederea adopţiei, se face în intervalul orar stabilit în conformitate cu regulamentele consiliului local.
(3) Revendicarea câinilor fără stăpân se poate face pe toată perioada de acces a publicului în adăposturile publice, perioadă prevăzută la alin. (1) şi (2).
(4) Accesul vizitatorilor în adăposturile publice pentru câinii fără stăpân se face cu respectarea regulamentului de organizare interioară. (5) Vizitatorii au dreptul să fotografieze şi să filmeze câinii din adăposturile publice

Astea sunt doar cateva din aspectele legale incalcate cu buna stiinta de conducerea ASPA!

Dupa cateva ore de stat in fata adapostului, unde am fost ignorati total, telefoane date la Primarie, la biroul de presa, la ASPA, fara un raspuns concret s-a facut un apel la 112 si am chemat un echipaj de politie. Acestia s-au prezentat la fata locului, le-am explicat despre ce este vorba, le-am insirat articolele din lege care ne dau dreptul de a vizita si fotografia cainii din adapost, dar ei oricum erau pe langa subiect. Au dat cateva telefoane, s-au urcat in masina si au fugit de la ”locul faptei” fara a ne da vreun raspuns de orice fel. S-a revenit cu apeluri la 112, am cerut alt echipaj de politie care sa vina sa constate si sa facem plangeri, dar ni s-a inchis telefonul in nas. Aceste lucruri sunt inregistrate de cei de la Kanal D si chiar au fost date la stiri. Deci Politia Romana refuza sa aplice, constate, sau cum s-o zice contraventiile in cazul unei incalcari a legii.

Legat de conditiile adapostului, pozele vorbesc de la sine….

Pozele sunt facute peste gard, in conditiile in care eram catarati pe pietroaie, masini. Discutiile cu cei din interior s-au purtat prin gard, au refuzat sa deschida si sa discute omeneste fata in fata ca intr-o tara civilizata din Uniunea Europeana. Sarma ghimpata peste tot, iar cainii se aud latrand. Eu personal nu am apucat sa pozez cainii dinafara, deoarece cred ca am nimerit partea unde inca nu erau bagati catei. O singura poza, preluata, arata ca exista caini acolo, ca sunt foarte multi intr-un spatiu foarte mic, nu se vedeau castroane cu apa si mancare si nici daca acei cainii au acces si inauntru. Stateau inghesuiti unul langa altul, zgribuliti de frig.
Mi se pare firesc ca dupa toate aceste lucruri sa se ridice zeci de intrebari.

Prima care ne vine in minte la toti : Ce se va intampla cu acei catei ?

Din pozele facute peste gard, se vede ca paza este asigurata de Politia Calare, un serviciu externalizat de Primaria Capitalei, apartinand unui SRL, FANDAX GRUP. What next?

Partea I. Video. “LINISTE” TOTALA….. DOAR CAINII LATRAU….
Azi am avut o zi…. neprevazuta…. Am vrut sa vedem noul “adapost” A.S.P.A… Surpriza!!!!! Nu exista niciun semn care sa arate ca acolo sunt caini… nu am primit nicio informatie de la Biroul de Presa al Primariei Bucuresti… a fost sesizata politia, insa acestia au plecat asa cum au venit…. Pentru ca…. NOUL ADAPOST SE AFLA IN INTERIORUL UNEI INCHISORI. Asadar, publicul nu are acces. Au fost si cei de la Kanal D prezenti. Si????? “LINISTE” TOTALA….. DOAR CAINII LATRAU….

Today I had a day …. unintended …. We wanted to see new “shelter” ASPA … Surprise!!!!! There is no sign to show that there are dogs … I have not received any information from the Bucharest City Hall Press Office … was notified the police, but they left as they come …. Because …. NEW SHELTER is inside a prison. Therefore, the public has no access. There were people at Kanal D present. And????? TOTAL SILENCE…. ONLY THE DOGS BARKING….
